
Kota Kinabalu: The Sessions Court fixed Feb 8 this year for pre-trial case management of a case involving a security guard charged with two counts of raping his daughter.
Judge Elsie Primus set the date for the 42-year-old man for serving documents pertaining to the case.
On the first count, the man is accused of raping the 16-year-old girl in a living room of a house in Kota Marudu at 1am on Sept 2, 2022.
On the second count, he allegedly raped the same alleged victim at the same place at midnight on Sept 8, 2022.
The offence, under Section 376(3) of the Penal Code, provides for a jail term of between eight and 30 years, and whipping at least 10 strokes, on conviction.
Deputy Public Prosecutor Mas Izzaty Lokman appeared for the prosecution while the man was not represented.
The court ordered the man to be remanded further pending the disposal of his case.
In another case, the court set April 14 this year for hearing a case involving a man charged with taking syabu repeatedly.
The trial date had been fixed for Mohd Safrizal Hori who maintained his plea of not guilty to the charge of taking the drug and he has several conviction records for committing the offence.
