Kota Kinabalu: A 43-year-old man claimed trial at the High Court on Wednesday to trafficking in firearms in Ranau three years ago.

Mechanic Elbino Djusni pleaded not guilty before Judge Wong Siong Tung to trafficking in three air rifles at 2.30am on Aug 6, in a house at Kg Kinarotuan.

The offence under Section 7(1) of the Firearms Act (Increased Penalties) 1971 carries a life imprisonment or death sentence, and whipping of at least six strokes of the cane, on conviction.

Wong set Feb 13-17, next year for trial and also fixed Nov 28 for case management.

No bail was offered to the accused.

Deputy Public Prosecutor Siti Amirah Muhammad Ali prosecuted while counsel Ram Singh, Kimberly Ye and Chen Wen Jye represented Elbino.

Meanwhile, an entertainment outlet owner was fined RM3,000 or three months jail by the Magistrate’s Court for running the premises without a licence last year.

Jacob Arthur Kimlon, 31, pleaded guilty before Magistrate Lovely Natasha Charles to committing the offence at The Light Music Café, T1 Bundusan in Penampang at 11.40pm on Dec 24, 2021.

The facts of the case presented by the prosecution stated that the raiding police found the premises was operating without a valid licence.

Jacob was charged under Section 3 of the Public Entertainment Ordinance 1958 which provides for a fine of up to RM50,000 or up to one year jail or both, on conviction.

Unrepresented, Jacob requested for a lower fine while the prosecution applied for an adequate sentence.

In another case, a 41-year-old man was jailed a month and fined RM2,500 or six months jail for having two stolen ‘L’ shaped iron rods.

Jeremenda Kinding admitted to having the stolen items belonging to Sabah Electricity Sdn Bhd at 2.55am on June 9 this year at a roadside in front of the SICC building here.

The offence under Section 411 of the Penal Code carries a jail term of up to five years or a fine or both, on conviction.

Unrepresented, Jeremenda requested for a jail sentence from the date of his arrest adding that he has dependants.

The prosecution applied for an adequate sentence.
