Having stolen phones: Man gets four months

Kota Kinabalu: A 40-year-old man was sentenced to four months’ jail by the Magistrate’s Court here for having stolen handphones.

Unemployed Roul Salumbi pleaded guilty before Magistrate Wan Farrah Farriza Wan Ghazali to having three stolen handphones belonging to one Rizki on Sept 23, this year, at 11.30am, at Pinoy Caf House, Jalan Tugu, Kg Air, here.

The offence under Section 411 of the Penal Code carries a jail term of up to five years or with fine or both on conviction.

The prosecution, in tendering the facts of the case, informed the court that the three phones were stolen earlier that day at 4am while the complainant was asleep at another coffee shop, in Kg Air.

Acting on information, police later located Roul at Pinoy Caf House at 11.30am.

During a search, the three phones were recovered from him and confirmed by the victim as his handphones.

In another similar case, a 47-year-old man was jailed eight weeks and fined RM1,000 or four weeks’ jail for having a stolen gold necklace.

Zulkifli Said pleaded guilty before Magistrate Dzul Elmy Yunus to having the stolen jewellery belonging to one Therecia Alexsa Wiljohn on Nov 14, this year, at 11am at a unit in Sembulan.

The court heard from the prosecution that Zulkifli was arrested by police at his home in Kg Sembulan and the stolen necklace was recovered from him.
