The Malaysian Anti-Corruption Commission (MACC) has recently received the green light from the Attorney-General Chambers to press charges against Tun Daim Zainuddin, a former finance minister. However, the anticipated legal proceedings have encountered a delay owing to Daim's health condition. MACC Chief Commissioner Tan Sri Azam Baki confirmed the approval last week but revealed that the former minister had been admitted to a private hospital before the charges could be formally filed. The specifics of Daim's health issues leading to his hospitalization remain undisclosed.
At 86 years old, Daim, also known as Che Abdul Daim Zainuddin, is expected to face at least one charge related to the failure to declare several properties jointly owned with his wife. The charges originate from information uncovered through the Pandora Papers, which exposed details about influential individuals globally utilizing offshore services to conceal their wealth.
Despite the readiness to proceed with the charges, Azam Baki stated that MACC is considering alternatives, including bringing a judge to the hospital for the reading of charges. However, he emphasized that this option would only be exercised if absolutely necessary, demonstrating sensitivity to Daim's health circumstances.
The investigation into Daim's financial affairs is grounded in Section 23 of the MACC Act 2009 and Section 4(1) of the Anti-Money Laundering, Anti-Terrorism Financing, and Proceeds of Unlawful Activities Act 2001. MACC had previously taken action by seizing Menara Ilham in Kuala Lumpur in December of the preceding year, a property linked to Daim's family, as part of the ongoing inquiry.
While the charges against Daim are imminent, the legal proceedings are temporarily on hold to accommodate the health concerns of the former finance minister. The MACC remains steadfast in its commitment to pursuing the case, underscoring the importance of addressing corruption allegations, even when faced with unforeseen health-related delays. This episode reflects the delicate balance between justice and health considerations within the realm of legal proceedings.
