A contract laborer has been sentenced to eight months in jail by a magistrate's court for causing injury and threatening to kill his own mother.
The accused, V. Kumaran, aged 48, was found guilty of both charges. The first count against Kumaran involved deliberately pointing a pair of scissors at his mother, V. Yallama, aged 73, and uttering the words, "I will kill you, Mama. If you die, I will also die today." This was done with the intention of causing anxiety to his mother. The charge falls under Section 506 of the Penal Code, which carries a maximum sentence of two years imprisonment or a fine, or both.
The second count against Kumaran involved causing physical injuries to his mother. Both offenses were allegedly committed at their residence at No 20, Pesara Klebang Jaya 12, Taman Kelebang Jaya, Chemor, at around 4pm. This offense falls under Section 323 of the Penal Code, which provides for a maximum sentence of two years imprisonment or a fine of up to RM2,000, or both. The Magistrate, S. Punitha, sentenced Kumaran to eight months imprisonment for the first offense and an additional four months imprisonment for the second offense.
The sentences are to be served consecutively, starting from the day of Kumaran's arrest. Deputy Public Prosecutor Muhammad Fahmi Kamaluddin handled the case on behalf of the prosecution, while the accused was represented by lawyer Siti Hajar Hamzah from the National Legal Aid Foundation (YBGK). According to the facts presented in court, Kumaran had visited his mother's house to ask for money.
However, his mother did not have the exact change, only a RM50 note that was meant for buying food supplies for the household. Despite this, Kumaran took the money and only returned RM20 to his mother. When his mother tried to leave the house, Kumaran forcibly pulled her inside. He then pushed her onto the bed and shoved her again until she fell onto the floor.
At the same time, Kumaran also strangled his mother and threatened her with a pair of scissors. The court took into account the seriousness of the offenses committed by Kumaran, as well as the fact that the victim was his own mother. The sentence serves as a reminder that acts of violence, especially against family members, will not be tolerated.
