
In a recent court case involving former Malaysian Prime Minister Najib Razak, the Federal Court rejected his application to have two judges recused from hearing an appeal regarding the admission of Jonathan Laidlaw as his advocate and solicitor.
The lead counsel for Najib, Tan Sri Muhammad Shafee Abdullah, argued that the judges in question had previously been involved in similar matters concerning Najib.
However, the application was dismissed by the three-member bench, chaired by Datuk Zabariah Mohd Yusof, who stated that there was no merit in the request. The appeal to the Federal Court was filed by Jonathan Laidlaw after the High Court had previously rejected his application to be admitted as an advocate and solicitor on July 21, 2020.
The public prosecutor, who was not initially named as a respondent in Laidlaw's appeal, subsequently filed an application to be included as the fourth respondent, arguing that they were a party in the proceedings at the High Court but had been unilaterally dropped in the appeal. In addition to this development, the Attorney-General's Chambers, the Malaysian Bar, and the Kuala Lumpur Bar Committee, all named as respondents in Laidlaw's appeal, have filed their own applications to strike out the appeal.
It is worth noting that Najib Razak is currently serving a 12-year jail sentence after the Federal Court upheld his conviction, sentence, and RM210 million fine for misappropriation of RM42 million from SRC International funds. This decision was handed down on August 23, 2021. Overall, this recent court case highlights the ongoing legal challenges faced by Najib Razak and the intricacies of the legal process.
The rejection of his application to recuse two judges from the hearing of Laidlaw's appeal emphasizes the court's determination to proceed with the case.
