
High Court directed the prosecution to finalize and submit the documents pertaining to the breach of trust (CBT) case involving RM6.6 billion in government funds. These funds were allegedly misappropriated in payments to the International Petroleum Investment Company (IPIC), implicating Datuk Seri Najib Tun Razak and Tan Sri Mohd Irwan Serigar Abdullah. The prosecution has been given a two-week deadline to complete this task.
Judge Datuk Muhammad Jamil Hussin issued this directive following a request from Datuk K Kumaraendran, the defence lawyer for Mohd Irwan. Kumaraendran pointed out that there are still 100 crucial documents that have not been provided to the defence. Among these documents are memos from Cabinet meetings and an email that references a defence witness's statement, which is critical for the defence’s case.
"This document is very important, especially to my client, but it was not given to us at all," Kumaraendran emphasized during the proceedings.
Previously, on March 3, 2022, Judge Datuk Muhammad Jamil Hussin denied the application from Najib and Mohd Irwan to be discharged without acquittal on all charges. The judge cited that the prosecution was prepared to proceed with the case.
Najib and Mohd Irwan, who served as the former Prime Minister and the former Chief Secretary to the Treasury respectively, pleaded not guilty to six counts of breach of trust on October 25, 2018. The charges relate to the alleged misappropriation of RM6.6 billion in government property linked to payments to IPIC. These offences were purportedly committed at the Ministry of Finance Complex in Putrajaya between December 21, 2016, and December 18, 2017.
The charges fall under Section 409 of the Penal Code, read in conjunction with Section 34. If found guilty, the accused could face a maximum prison term of 20 years, along with caning and fines.
This high-profile case continues to draw significant attention due to the substantial amount of money involved and the high-ranking positions of the accused. The forthcoming weeks are expected to be crucial as the prosecution finalizes the documentation, which will play a vital role in the proceedings moving forward.
