The High Court is set to hear the Attorney General's application for leave to initiate committal proceedings against former Umno Supreme Council member Isham Jalil on March 4. Deputy public prosecutor Mohamad Mustaffa P Kunyalam mentioned that the hearing would be before Judge Datuk Noorin Badaruddin. The Attorney General seeks to hold Isham in contempt of court over comments made during an interview titled "Townhall for Justice: Keadilan Sebenarnya Untuk Siapa." The statements allegedly challenged the recusal process of Judge Datuk Collin Lawrence Sequerah, who presided over the 1MDB trial, and disputed the appeal process at the Federal Court for the SRC International case involving former Prime Minister Datuk Seri Najib Razak. The Attorney General claims that Isham's comments pose a real risk of undermining public confidence in the judiciary and amount to interference with the administration of justice.
The case stems from an ex-parte application filed on December 28, where the Attorney General also seeks imprisonment or a fine for Isham. The comments in question were published on "The Malaya Post" Facebook page on September 30, 2023. The Attorney General argues that Isham's remarks humiliate the judiciary, constituting interference in the administration of justice and a serious insult. Deputy Registrar Nur Azizah Jaafar presided over the case management, instructing the public prosecutor to file submissions by February 29.
The legal proceedings highlight the sensitivity of comments on high-profile trials and the potential consequences for those perceived to undermine the judicial process. The upcoming hearing will provide a platform to assess the merits of the Attorney General's case against Isham Jalil and the potential implications for free expression and legal commentary on judicial matters in Malaysia. As the legal process unfolds, it will be essential to scrutinize the arguments presented and the court's decision regarding the alleged contempt of court, shedding light on the boundaries between free speech and the integrity of the judiciary.
