The Himachal Pradesh High Court has stayed the issuance of appointment letters for the posts of CBSE English Teachers.

The court directed that no appointment letters shall be issued to candidates selected for the posts of CBSE English teachers without its prior permission. The interim order was passed by Justice Ajay Mohan Goel.

According to the petitioner, the recruitment process was initiated through a notification dated January 29. Clause 5 of the advertisement prescribed the eligibility criteria and the manner in which merit was to be determined.

It was contended that the merit list subsequently prepared was not based on Clause 5 of the recruitment notification but on information published in certain newspapers, thereby amounting to a change in the prescribed criteria during the selection process.

During the hearing, it was brought to the Court’s notice that the final result had already been declared. The Court granted time to counsel for the Himachal Pradesh State Selection Commission to obtain instructions and clarify the position by the next date of hearing.

Observing that the issuance of appointment letters at this stage could lead to a multiplicity of litigation, Justice Ajay Mohan Goel ordered that no appointments to the posts of CBSE English Teachers shall be made without the leave of the court until further orders.

The matter is scheduled to be taken up on the next date of hearing.
