Hotel company claims trial to charge over uncertified lifts

Kota Kinabalu: The Sessions Court here on Wednesday has charged a company, Kinabalu International Hotel Sdn Bhd, with installing passenger lifts without a valid certificate issued by an officer from the Occupational Safety and Health Department (Dosh) or an authorised person.

The company, through its representative, pleaded not guilty before Sessions Court Judge Amir Shah Amir Hassan to permitting the operation of passenger lifts without a valid certificate.

The offence allegedly occurred at about 11.30am on Oct 7, 2025, at the Hyatt Regency Kinabalu here.

The charge is framed under Section 27D(1) of the Occupational Safety and Health Act 1994, punishable under Section 27D(5) of the same Act, which provides for a fine of up to RM100,000, or a jail term of up to one year, or both, upon conviction.

The court set April 28 for mention and allowed bail at RM5,000 with one local surety without deposit, with prosecuting officer Christy Claire De Guzman appearing for DOSH and counsels Vanessa Maria Marimuttu and Adele Chin representing the company.
