"I Want to Make Them Bankrupt": MACC’s Azam Baki Scares the Corrupt

In a bold and ambitious statement, Tan Sri Azam Baki, Chief Commissioner of the Malaysian Anti-Corruption Commission (MACC), has announced a transformative shift in the agency's approach to tackling corruption. Speaking recently, Azam emphasized that MACC’s strategy now extends beyond merely arresting and prosecuting corrupt individuals; it aims to financially incapacitate them, making them bankrupt as a deterrent against corruption.

Azam's declaration marks a significant escalation in MACC's efforts to combat corruption. Historically, the focus has largely been on apprehending and bringing corrupt offenders to justice. However, Azam’s new directive seeks to target the financial foundations of corruption by aggressively pursuing and seizing assets acquired through illegal means.

In 2024 alone, MACC has already successfully repatriated RM1.3 billion in illicit assets, which has been returned to the government. This figure underscores the effectiveness of the agency’s enhanced approach, which is designed not just to penalize but to dismantle the economic advantages gained by corrupt actors. Azam believes that this strategy will serve as a powerful deterrent, instilling a fear of financial ruin among those tempted to engage in corrupt practices.

Central to this strategy is the enforcement of the Anti-Money Laundering, Anti-Terrorism Financing, and Proceeds of Unlawful Activities Act 2001. This legislation empowers MACC to seize and confiscate assets linked to criminal activities, thereby ensuring that ill-gotten gains are recovered and returned to the public treasury. Azam underscores the need for specialized knowledge and expertise in investigative and forensic techniques to trace and reclaim these assets, as corrupt individuals often hide their wealth through proxies or complex financial schemes.

The case of 1Malaysia Development Bhd (1MDB) serves as a prime example of MACC’s effectiveness in this new approach. The concerted efforts of MACC, alongside other agencies, resulted in recovering RM29 billion of the RM42 billion originally misappropriated. This success demonstrates the potential impact of MACC’s enhanced strategy in both recovering stolen assets and setting a precedent for future cases.

In addition to its enforcement efforts, MACC is also focusing on prevention and community education. The agency has integrated social media and mainstream media campaigns to raise awareness about corruption and foster a culture of integrity. Educational initiatives, such as the Anti-Corruption Student Group at Sultan Zainal Abidin University, aim to instill anti-corruption values from an early age.

Azam also highlighted the importance of adopting best practices from other countries. While acknowledging the lessons learned from places like Hong Kong and Qatar, he advocates for the modernization of Malaysia's service systems. Digital solutions, such as those used for traffic compound payments in Qatar, can reduce opportunities for corruption and streamline public services, thus enhancing transparency and efficiency.

Looking ahead, MACC’s strategy will continue to evolve, with a focus on addressing significant areas of concern such as bribery, procurement corruption, and grand corruption. By targeting the financial assets of corrupt individuals and integrating advanced investigative techniques, MACC aims to create a more robust and deterrent anti-corruption framework.
