MANILA, Philippines — The International Criminal Court (ICC) is expected to rule on former president Rodrigo Duterte's challenge to its jurisdiction over his case concerning alleged crimes against humanity stemming from his controversial campaign against drugs on April 22, 2026.
The ICC, however, will announce its decision in the absence of the former Philippine leader who, in a letter dated April 10, said he was waiving his right to be physically present at the hearing.
“I hereby instruct my lawyers to hear the aforementioned judgment in my place,” said Duterte who did not state his reasons for his absence.
The letter was attached to a formal “request to waive appearance” submitted by his lead defense counsel, Nicholas Kaufman, and which was made public by the ICC on April 13.
The jurisdiction issue remains central to Duterte’s defense. His legal team is seeking to overturn a decision issued in October 2025 by Pre-Trial Chamber I, which affirmed that the court may proceed with the case despite the Philippines’ earlier withdrawal from the ICC.
Aside from jurisdiction, Duterte’s lawyers have also challenged previous rulings related to interim release and findings regarding his health condition.
