Kota Kinabalu: A spare parts seller was fined RM1,600 or two months’ jail by the Magistrate’s Court, here, Monday for having gambling paraphernalia, last year.

Bobby Alejandro, 27, pleaded guilty before Magistrate Lovely Natasha Charles to having six lottery tickets without a licence at Koidupan town in Penampang at 4pm on Nov 6, 2022.

The court was informed by the prosecution that the police detained Bobby during Ops Noda.

Police seized the paraphernalia from Bobby, including a handphone and RM87 in cash.

Unrepresented, Bobby requested a lower fine on the grounds that he works as spare parts seller and is married with two children.

The prosecution applied for an adequate sentence.

The magistrate granted the prosecution’s application for the seized items to be disposed of and for the seized money to be forfeited as government revenue.

Bobby was charged under Section 9(1) of the Common Gaming House Act, which carries a jail term of up to six months, or fine of up to RM3,000, or both, on conviction.

In another case, five people were penalised for committing drug-related offences.

Three of them Modzmal Mohamad, Masnah Majnil and Adi Queshaen pleaded guilty to taking syabu at separate locations here.

Modzmal was jailed six months while Masnah and Adi were fined RM2,200 or six months’ jail each.

Taking drugs under Section 15(1) of the Dangerous Drugs Act provides for a fine of up to RM5,000 or up to two years jail, on conviction.

Meanwhile, the other two Richard Mudin, 51, and Sahnazrul Samsudin, 32, pleaded guilty to having syabu weighing 0.09gm and 0.11gm, respectively on Jan 16 and Jan 17 at Kg Air here and in Inanam.

Richard was fined RM2,500 or nine months’ jail while Sahnazrul was handed 11 months’ jail from the date of his arrest.

Richard and Sahnazrul were charged under Section 12 (2) of the Dangerous Drugs Act 1952 provides for a fine of up to RM100,000 or up to five years jail or both, on conviction.
