
Kota Kinabalu: A paperless man was jailed seven months for stealing a fish barrel.
Amir Samma pleaded guilty before Magistrate Marilyn Kelvin to stealing an orange-coloured fish barrel belonging to Desa Kemangi Seafood & Grill, Harbour City, here, on Feb 21, this year, at 5am.
The offence of theft under Section 379 of the Penal Code carries a jail term of up to seven years, or a fine, or both, on conviction.
The charge sheet stated that there was CCTV footage of the accused moving the item from the complainant’s premises.
The accused was arrested while pushing the fish container using a trolley by the security guard on duty.
The court ordered Amir to serve the jail sentence from the date of the arrest.
After completing his jail sentence, he was ordered referred to the Immigration Department for further action.
In another case, two illegal foreigners were jailed for having syabu.
Jasni Manambulan and Al Hafiz Arman, pleaded guilty separately for having syabu at separate location at Kampung Air and Pulau Gaya, in February, this year.
The offence under Section 12(2) Dangerous Drugs Act carries a jail term of up to seven years, or a fine, or both, on conviction.
Jasni was jailed seven months for having 0.09gm syabu, while Al Hafiz was jailed eight months for having 0.04gm syabu.
The duo were ordered to serve the jail sentence from the date of their arrests and referred to the Immigration Department after completing their jail sentence, for further action.
Meanwhile, Marsius Elizius was fined RM2,700 or nine months in jail for having 0.08 grammes syabu.
Marsius represented by Jagnesh Jaya from National Legal Aid Foundation (YBGK) and asked for leniency as this is the accused first offence and has children to look after.
