The Immigration Department of Malaysia (JIM) has issued a stern reminder to foreign workers in the country, emphasizing the potential consequences of marrying a Malaysian while holding a temporary foreign worker permit (PLKS). The department, through an official Facebook post, clarified that such unions violate the terms outlined in the PLKS, automatically rendering the permit null and void.

The repercussions of this violation extend to deportation, in accordance with the Immigration Act 1959/63 (Act 155), as highlighted by JIM. Foreign workers who find themselves in this situation will be required to leave Malaysia promptly.

The advisory also directed attention to Malaysians, particularly women, urging them to be aware of the risks associated with marrying a foreign worker holding a PLKS. The post emphasized that should they choose to proceed with the marriage, they may find themselves left behind by their deported spouses.

JIM provided additional clarification regarding the status of such marriages, differentiating between Muslim and non-Muslim couples. For Muslim couples who fulfill all the requirements under Islamic laws, their marriage is considered valid, despite the imminent deportation of the PLKS holder spouse. However, this complicates divorce proceedings, as the deported individual would be subject to Syariah Court jurisdiction.

In the case of non-Muslim unions, the High Court holds the authority to dissolve and deregister civil marriages, introducing another layer of complexity to the legal process.

Importantly, the announcement does not imply a blanket prohibition on marriages between foreign workers and Malaysians. Instead, the procedure becomes more intricate, requiring foreign workers to consult with their respective country's embassies and seek approval from immigration.

JIM revealed ongoing efforts to streamline and standardize the procedures for marriages between foreign workers and locals. Engaging with relevant parties, the department aims to create a more uniform and transparent process for these unions.
