Ngeh Koo Ham, the Beruas MP, emphasized the importance of integrating non-Muslim constitutional experts into the committee examining potential conflicts between shariah laws and the Federal Constitution. This suggestion aims to ensure a comprehensive and balanced perspective during legal revisions.

The proposal comes in light of Prime Minister Anwar Ibrahim's announcement on November 21 in the Dewan Rakyat. Anwar had conveyed the government's approval for establishing a special committee, which received endorsement from the Conference of Rulers. This committee's primary objective is to elevate the stature of the shariah court.

Further details emerged during the parliamentary session when Na’im Mokhtar, the religious affairs minister, revealed that a distinguished former chief justice would spearhead the committee. This committee's core responsibility revolves around scrutinizing issues concerning the division of authority between federal and state jurisdictions. Specifically, they will delve into the competency of state assemblies in crafting shariah laws.

Expressing his observations, Ngeh highlighted that the current committee comprises solely Muslim members. To foster a holistic dialogue and ensure a diverse array of viewpoints, he stressed the necessity of incorporating non-Muslim constitutional experts into the committee's composition. According to Ngeh, their inclusion would guarantee that perspectives outside the Muslim community are considered thoroughly before any law modification proposals.

Furthermore, Ngeh emphasized the significance of involving a representative from the Malaysian Bar in this committee. Given that the Malaysian Bar stands as a statutory body with the primary objective of safeguarding the fairness and justice of proposed laws, its inclusion would enhance the committee's credibility and thoroughness.

Reflecting on the nation's foundational document, Ngeh remarked on the intricacies and thoughtfulness embedded within the constitution. He described it as the paramount law of the land, meticulously crafted to unify a multifaceted nation like Malaysia. The constitution, in its essence, harmonizes various aspects, from race, religion, and language to cultural nuances, regional disparities, and the pivotal role of rulers. Ngeh emphasized that any contemplated changes affecting a particular race or religion, which subsequently impacts others, necessitate exhaustive discussions to preempt potential conflicts.

In a subsequent development on December 5, the special committee received leadership from former chief justice Zaki Azmi. Assisting him, the committee comprises eminent figures such as former federal court judge Zawawi Salleh, Selangor Islamic religious council member Salehuddin Saidin, and the chief shariah judge of the Melaka shariah court, Nadzri Abdul Rahman.
