Indonesian fails in final appeal against death sentence

Kota Kinabalu: An Indonesian oil palm plantation contract worker failed in his final appeal against his death sentence for murdering his countryman in Beluran six years ago.

The Federal Court’s three-member panel chaired by Chief Justice of Sabah Sarawak Datuk Abdul Rahman Sebli, Justices Datuk Zabariah Mohd Yusof and Datuk Hasnah Datuk Mohammed Hashim dismissed Sajid Bairula’s appeal.

The court in their unanimous decision held that there was no merit in the appeal and affirmed the conviction and sentence imposed on Sajid.

Sajid was on Sept 23, 2019 sentenced to death by the Sandakan High Court after he was found guilty of murdering a 14-year-old Indonesian boy at 2.30pm on Jan 30, 2017 at the worker’s house of Masih Jaya plantation, Sugut, Beluran.

The charge under Section 302 of the Penal Code carries the death penalty, on conviction.

Sajid’s appeal to the Court of Appeal against the High Court decision was rejected on Dec 9, 2021.

Counsel Majnah Abdillah represented him while Deputy Public Prosecutor Mohd Amril Johari appeared for the prosecution.

Meanwhile, an unemployed man was charged with having an imitation pistol in a Magistrate’s Court.

Jaccqres Kadau, 50, pleaded not guilty before Magistrate Stephanie Sherron Abbie.

Jaccqres was accused of having the imitation pistol at 1.30am on Feb 8, this year at 7-Eleven at Damai Plaza.

He was charged under Section 36(1) of the Arms Act 1960 which carries a jail term of up to a year or fine of up to RM5,000 or both, on conviction.

The Magistrate set March 3 for pre-trial case management and released Jaccqres on a bail of RM3,000 in two sureties.
