Kota Kinabalu: A 32-year-old man was jailed five years and ordered to get two strokes of the cane for taking syabu repeatedly.

Sessions Court Judge Amir Shah Amir Hassan meted out the sentence to Marknerolaki Bindami who admitted to the charge against him on Friday.

AdvertisementHe was found taking the drug at 2.05pm on May 25, 2023 after his urine tested positive for drug at the police station here.

Marknerolaki has two previous conviction records for taking the drug.

Read more The offence under Section 15(1)(a) and punishable under Section 39C(1) of the Dangerous Drugs Act carries a jail term of between five and seven years, and whipping, on conviction.

The court ordered Marknerolaki to serve the jail sentence from the date of his arrest.

AdvertisementAfter completing his jail sentence, Marknerolaki was ordered to be placed under police supervision for three years.

During mitigation, Marknerolaki who was not represented, asked for leniency saying that he has family to look after.

Advertisement (adsbygoogle = window.adsbygoogle || []).push({});However, Deputy Public Prosecutor Nurul Shaferrah Mad Iskim urged the court to impose a deterrent sentence as Marknerolaki had repeated to taking the drug.

In another court, six people were jailed for committing immigration offences, respectively.

They were Masir Gastar Alam, Farmina Sahidjuan, Zulkifli Abdul, Arnold Dinlasa, Abdul Han Binajak and Arnalin Boni.

Masir was jailed six months for overstaying in the State for three months after his social visit pass had expired on Oct 30, 2024 and he was arrested on Feb 7 this year at a rented house in Tuaran.

Farmina was sentenced to 10 months’ jail for entering the State and re-entered the State illegally after she was deported to her hometown.

Meanwhile, the rest were jailed four months each for entering the State without any valid documents and they were detained by the Immigration personnel after failing to produce their identity documents at different places in Kudat, Sepanggar, City and Penampang in February this year.

The six were ordered referred to the Immigration Department after completing their jail sentence for further action.
