
Kota Kinabalu: A 39-year-old father was jailed eight years and three months plus three strokes of the cane for taking syabu repeatedly.
Sessions Court Judge Elsie Primus meted out the sentence to Mohd Afifi Nanun, after ruling that the prosecution had proven its case beyond reasonable doubt against Mohd Afifi, on Monday.
Mohd Afifi was found guilty of taking the drug at 4.10pm on Dec 27, 2023 after his urine was tested positive for drug and he had one conviction record under Section 39C(1) of the Dangerous Drugs Act (DDA) for having several convictions for taking drugs.
He was convicted under Section 39C(2) of DDA and read together with Section 39B of DDA.
The court ordered Mohd Hafifi to serve the jail sentence from the date of his arrest on Dec 27, 2023.
After completing the jail sentence, the court also ordered Mohd Hafifi to be placed under police supervision for three years.
During mitigation, Mohd Hafifi who was not represented, asked for a lenient sentence by telling the court that he has eight children and five of them are still schooling.
He also told the court that he needed to look after his old parents as he was the breadwinner of his family.
Mohd Hafifi also promised that once released from prison, he would not repeat the offence.
However, Deputy Public Prosecutor Sofia Sawayan urged the court to impose a heavy sentence on the grounds that Mohd Hafifi was not remorseful as he kept repeating to take drugs.
The prosecution had called five witnesses and only one defence witness testified during the hearing.
