
Kota Kinabalu: A 32-year-old man was jailed seven months and fined RM2,000 or two months in jail by the Magistrate’s Court for retaining a stolen vehicle.
Roffer Asyur Joseph pleaded guilty before Magistrate Dzul Elmy Yunus to keeping a stolen Isuzu D-Max, belonging to TBT Precast Sdn Bhd, at the basement parking area of Aeropod Commercial Square, Jalan Kepayan, at 5.45pm on Aug 13.
The charge under Section 411 of the Penal Code carries a punishment of imprisonment for a term of not less than six months and not more than five years, and is also liable to a fine, on conviction.
The court ordered Roffer to serve the jail term from the date of arrest.
Earlier, the court heard from the prosecution that Roffer was arrested following a police investigation on a related report, and he later led the police to the basement car park where the stolen vehicle had been hidden pending its sale.
Unrepresented, Roffer requested a lenient sentence citing that he has no permanent job, married with two children and was the sole-breadwinner.
He expressed deep remorse for his actions, saying he was genuinely ashamed of his conduct.
The prosecution applied for a deterrent sentence.
In another case, a 37-year-old illegal immigrant was jailed two months for stealing from a church building.
Kasim Ibrahim pleaded guilty before Magistrate Marilyn kelvin to stealing a small rosary bag at the Sacred Heart Cathedral in Karamunsing at 8am on July 28.
He was charged under Section 380 of the Penal Code which carries a maximum penalty of 10 years in prison, a fine, and for repeat offences, whipping, on conviction.
According to the facts of the case presented by the prosecution, a report was lodged by the complainant on 28 July after a bag containing a small rosary bag, among others, were missing from the Pastoral Office of the cathedral.
Acting on information, a police raided a house at Kinarut Settlement, at 3.10pm on July 31 and found the missing items near Kasim.
Kasim was ordered to serve the sentence from the date of arrest and to be referred to the Immigration Department thereafter.
Inspectors Mohamad Hamidi Mohamad Hamzah and Yusdi Basri prosecuted.
