
Kota Kinabalu: The Sessions Court on Wednesday sentenced a 37-year-old man to five years’ jail and ordered given three strokes of the cane for robbing a woman of her handbag.
Judge Hurman Hussain imposed the sentence on Mohd Zainie Sabli who admitted to robbing the 23-year-old woman.
Mohd Zainie had committed the offence together with an accomplice still at large at 11.21pm on Aug 25 this year inside a car parked at the Pisang Goreng Erma behind the Golden Putatan compound in Putatan.
He was charged under Section 395 of the Penal Code which carries a jail term of up to 20 years, and whipping, on conviction.
The court ordered Mohd Zainie to serve the jail sentence from the date of his arrest.
Mohd Zainie who was not represented, asked for a light sentence saying that he has three children who needed him as he already divorced with his wife.
He told the court that he is ready to receive whipping sentence if it would be shortened the jail sentence.
In reply, Deputy Public Prosecutor Fazriel Fardiansyah Abdul Kadir prayed for a heavier sentence as it was serious offence and very rampant nowadays.
The court heard that the incident happened while the victim was inside her car to rest when suddenly a car stopped near her car and two men went out from the car.
One of the man had tried to pry off her window car and the other man had punched her window car two times.
When they managed to open the windows, the men who one of them later identified as Lajah, grabbed her handbag and escaped from the scene.
Following a police report, Lajah was arrested on Sept 24 this year.
