Kota Kinabalu: A 42-year-old man was jailed for 18 months for causing injury to his brother-in-law and threatening to hurt his sister.
Wendy Doivit pleaded guilty to two charges before Magistrate Farrah Fariza Wan Ghazali.
On the first count, he was sentenced to seven months’ jail for voluntarily causing hurt to his 48-year-old brother-in-law at a house in Kampung Ganang, Kepayan, at 4.20pm on Oct 22 this year.
The offence falls under Section 323 of the Penal Code, read together with Section 326A of the same Code. Section 323 provides for imprisonment of up to one year, a fine of up to RM2,000, or both, upon conviction.
On the second count, Wendy was sentenced to another 11 months’ jail for criminal intimidation against his 49-year-old sister at the same place at 8.35pm on Oct 21 this year.
He had uttered the words “Saya kasi pecah kau” (I will smash you), causing his sister to fear that he would carry out the threat.
The offence under Section 506 of the Penal Code carries imprisonment of up to two years, a fine, or both, upon conviction.
The court ordered Wendy to serve both sentences consecutively from the date of his conviction.
The court heard that on Oct 21 at about 8.35pm, the complainant was at her family home in Kampung Ganang, Kepayan, when she reprimanded her younger brother and asked him to lower the volume of his mobile phone because their father was ill.
Angered by the reprimand, Wendy threatened his elder sister, telling her, “Call your husband, I’ll smash you.”He also challenged her to call the police and behaved in a manner that caused her to fear that he would act violently towards her.
The incident was witnessed by their father, who was in the living room at the time and clearly heard the threat.
The following day, Wendy caused injuries to his brother-in-law when he approached him and kicked him once on the buttocks.
When his brother-in-law attempted to block a subsequent kick with his right hand, his right thumb became painful and swollen.
The incident was witnessed by his wife, who is Wendy’s elder sister and was present at the scene. She subsequently took her husband away.
As a result of the incident, Wendy’s brother-in-law suffered pain in his right hand and swelling of his right thumb.
Deputy Public Prosecutor Esther Cynthia Jebon prosecuted the case, while Wendy was unrepresented.
