Kota Kinabalu: A 28-year-old man who threatened to injure his sister for not giving money was jailed nine months.

Mohd Shafie Ros pleaded guilty before Magistrate Marilyn Kelvin to committing the offence against Siti Norsafika Ros on Jan 24 at 10am in a house at Kg Lok Urai, Pulau Gaya.

Shafie earlier informed the court that he wish to change his plea to guilty to the charge under Section 506 of the Penal Code which carries a jail term of up to two years or fine or both, on conviction.

Inspector Alia Nuurlysa Adnan, prosecuting, said the complainant was at home when Shafie went berserk, damaging properties inside the house and threatening to hurt her if he was not given money.

Read more Investigations revealed that prior to the incident, Shafie had been asking the complainant for money every day and would threaten to harm her if she did not comply.

Duty Counsel Lim Ming Zoong @ Lawrence, representing Shafie, requested a lenient sentence, saying that he is married with children and previously worked as an assistant tourist guide.

He added that Shafie had been under remand for eight months as he failed to secure the bail offered by the court.

The prosecution applied a deterrent sentence.

Marilyn ordered the jail sentence to run for the date of Shafie’s arrest.

In another case, a man was fined RM5,000 or a month’s jail for operating an entertainment outlet beyond the permitted time.

Henry Francis, in his 30s, pleaded guilty to committing the offence at a cafe and lounge in Bundusan, Penampang on June 22 at 3.10am.

The charge stated that Henry had operated the premises beyond the stipulated time of 1am as stated in the licence.

Henry had committed an offence under Section 4(1) of the Public Entertainment Ordinance 1958 which is punishable under Section 11 of the same Ordinance that provides for a fine of up to RM5,000 or up to one year or both, on conviction.

Unrepresented, Henry requested leniency, stating that the premises were temporarily closed to resolve matters related to the present case, adding that he has a family to look after.

The prosecution applied an appropriate sentence.

The court also ordered the exhibits to be returned to the owner as applied by the prosecution.

Meanwhile, two men were each fined RM2,500 or six months jailed each for taking syabu.

Azwan Rasit and Dickson Chong admitted to committing the offence on Aug 8 and Aug 10, respectively here.

The offence under Section 15(1)(a) of the Dangerous Drug Act, provides for a fine of up to RM5,000 or up to two years jail, on conviction.
