
Former Finance Minister Tun Daim Zainuddin and his family faced a setback in their legal battle as their appeal to proceed with a judicial review against the Malaysian Anti-Corruption Commission (MACC) investigation into their financial affairs was unanimously rejected by a three-member panel of the Court of Appeal.
The panel, comprising Judges Datuk Azizah Nawawi, Datuk Hashim Hamzah, and Datuk Azizul Azmi Adnan, ruled that a criminal investigation is not subject to judicial review, thus denying the request for permission to proceed. This latest development follows a previous ruling on March 4 by a High Court Judge who rejected Daim and his family's initial application for a judicial review. The High Court Judge concluded that they failed to substantiate allegations of mala fide (bad faith) against the MACC officers conducting the investigation, further complicating their legal recourse.
Daim, aged 85, along with his wife Toh Puan Nai'mah Abdul Khalid and their four children, Asnida, Md Wira Dani, Muhammed Amir Zainuddin, and Muhammed Amin Zainuddin, alongside Ilham Tower Sdn Bhd, initiated the judicial review application on January 10, naming MACC and the Public Prosecutor as respondents.
