The trial of SRC International Sdn Bhd’s US$1.18 billion civil lawsuit against Datuk Seri Najib Tun Razak is set to resume on July 29 at the High Court here in Kuala Lumpur. This high-profile case, which has drawn considerable public and media attention, involves allegations of significant financial misconduct by the former Prime Minister during his tenure.
Najib’s lawyer, Tan Sri Muhammad Shafee Abdullah, informed Judge Datuk Ahmad Fairuz Zainol Abidin that the defense intends to recall Tan Sri Ismee Ismail, a former SRC director, for further cross-examination. Ismee, who is currently abroad, is expected to return to Malaysia on June 30, leading the court to reschedule the trial to July 29 to accommodate his availability.
Previously, Ismee had been cross-examined by Najib’s other lawyer, Harvinderjit Singh. However, Muhammad Shafee has requested that Ismee be recalled to address additional questions that the defense believes are crucial for their case. This move indicates the defense's strategy to thoroughly examine the testimonies and evidence presented by key witnesses.
SRC International, under its new management, filed this lawsuit in May 2021. The company accuses Najib of committing a criminal breach of trust, abusing his power, and misappropriating the company’s funds for his personal gain. These allegations stem from Najib's time as a key figure in the company and in the Malaysian government.
The lawsuit seeks a court declaration holding Najib liable for the company’s substantial losses, citing his breach of duty and trust. Specifically, SRC International demands that Najib repay the RM42 million loss the company claims to have incurred due to his alleged misconduct. The RM42 million is part of the larger sum that is at the center of the financial scandal involving SRC International.
This case is a significant chapter in the ongoing legal battles faced by Najib Razak, who has been embroiled in multiple legal issues related to the 1MDB scandal. The upcoming sessions of the trial are expected to delve deeper into the accusations against Najib, examining the intricate details of the financial transactions and decisions that led to the alleged misappropriation of funds. The proceedings on July 29 will be closely watched as they will provide further insights into the defense's arguments and the prosecution's efforts to hold Najib accountable for the alleged financial crimes.
