Killing wife: Man to enter defence

Kota Kinabalu: A 61-year-old man was ordered to enter his defence on a charge of murdering his wife three years ago.

High Court Judge Leonard David Shim made the order for construction worker Alip Abu Bakar after ruling that the prosecution had established a prima facie case against Alip, Tuesday. The court set Nov 2 this year for Alip’s defence.

Alip is accused of killing his wife Ayang Hamjani, 61, at 1.45am, on June 17, 2019 at a unit of the Permai factory worker’s quarters, Likas.

The offence, under Section 302 of the Penal Code, carries the death sentence upon conviction.

Pending the disposal of his case, Alip was ordered to be remanded further as the charge against him has no provision for bail. The prosecution had called four witnesses in the hearing.

Deputy Public Prosecutor Ali Imran conducted the prosecution while Alip was represented by assigned counsel Shahlan Jufri.

In another case, a 28-year-old Sarawakian charged with trafficking 2,129.1gm of syabu, was also ordered to enter his defence on the charge.

High Court Judicial Commissioner Amelati Parnell set Dec 9 for Anthony Chan Wei Onn’s defence, after ruling that the prosecution had succeeded to establish a prima facie case.

Chan, an air-conditioner repairman, was accused of trafficking the syabu at 6.20pm on July 12, 2019 at the J&T Express premises on the ground floor, Kolam Plaza Phase 1, Jalan Lintas.

He had on Jan 20, 2020 claimed trial to the charge under Section 39B(1)(a) of the Dangerous Drugs Act which carries the death sentence or life imprisonment and whipping of not less than 15 strokes if not sentenced to death, on conviction.

A total of 14 witnesses were called to testify during the hearing.

Deputy Public Prosecutor Khairulnizam Abu Bakar, from the Customs Department, prosecuted while Chan was represented by counsel Ram Singh, Kimberly Ye and Chen Wen Jye.
