Legal Battle Unfolds: Clare Rewcastle-Brown Challenges Defamation Conviction with High Court Appeal

Clare Rewcastle-Brown, the renowned editor of Sarawak Report, finds herself embroiled in a legal battle following a two-year jail sentence handed down by a Magistrates Court for allegedly defaming Sultanah Nur Zahirah of Terengganu. Determined to challenge the conviction, Rewcastle-Brown's lawyer, Guok Ngek Seong, has announced plans to appeal the decision and is urging the High Court to intervene, citing significant legal irregularities.

Guok emphasized that the appeal will be swiftly filed, citing Section 425A (1) of the Criminal Procedure Code, which he argues was disregarded during the trial proceedings. He highlighted the prosecution's failure to produce Rewcastle-Brown in court, despite her known whereabouts in London, questioning the validity of the trial conducted in her absence.

The trial proceeded without Rewcastle-Brown's presence, a move deemed irregular by her legal team, as she had not absconded after claiming trial, thus theoretically retaining her right to be present. Guok criticized the authorities for not taking necessary steps to bring her to Malaysia, despite being aware of her location.

Rewcastle-Brown's conviction stems from allegations of publishing defamatory remarks in her book, *The Sarawak Report: The Inside Story of the 1MDB Expose*, for which she was prosecuted under Section 500 of the Penal Code. The court's decision mandates her immediate imprisonment.

The legal saga originated in 2018 when Sultanah Nur Zahirah initiated legal proceedings against Rewcastle-Brown, seeking RM100 million in damages for alleged defamatory statements made in the book. The Sultanah vehemently refuted claims suggesting her involvement in corrupt activities and interference in the affairs of the Terengganu government. Similarly, she denied allegations of using her influence to establish the Terengganu Investment Board (TIA), later renamed 1Malaysia Development Berhad (1MDB).

Moreover, Sultanah Nur Zahirah categorically denied assertions from the book that she facilitated Jho Low, a fugitive businessman, in securing a position as an advisor to the TIA. The ongoing legal battle underscores the contentious nature of the allegations and the complexities surrounding the case.
