Kota Kinabalu: A 2021 Unduk Ngadau contestant agreed to a question that she never shared her locations with her friends and boyfriend when she was with the 2021 State Unduk Ngadau technical head who was charged with four counts of molesting her.
She agreed with the defence that when she and Philip Among went to a restaurant and inside Philip’s car on the way to Metro Town office, she did not share her location with her friends and boyfriend to fetch her even after she was allegedly molested by Philip between 2pm and 3pm on May 19, 2021.
She agreed with counsel Abdul Fikry Jaafar Abdullah, who represented Philip, that while she was with Philip at the restaurant, she did not share her location with his friends and boyfriend.
The 22-year-old alleged victim testified as the first witness before Magistrate Stephanie Sherron Abbie, Tuesday.
While at the restaurant, the witness agreed that she did not try to run away from Philip.
Fikry: After you and Philip went to hotel to keep your things, you and Philip went to the restaurant, do you agree?
Witness: Agreed.
Fikry: While at the restaurant, you did not call your friends to fetch you at the restaurant, do you agree?
Witness: Agreed.
Fikry: You did not cry or ask for help while at the restaurant, do you agree?
Witness: Agreed.
Fikry: Do you agree that you told Philip you were interested to work at his company?
Witness: Agreed.
Fikry: Do you agree that while in the restaurant, you asked Philip to help you to get Unduk Ngadau votes by buying the votes?
Witness: Disagreed.
Fikry: Do you agree that your demand was strongly rejected by Philip?
Witness: Disagreed.
The witness also agreed that Philip did not pull her hands and forced her to go inside his car after they spent more than one hour at the restaurant.
She agreed that she did say Philip had molested her while on the way back from the restaurant at 9.45pm.
Fikry: Do you agree that you and Philip went together to Metro Town office after having dinner at the restaurant?
Witness: Agreed.
Fikry: While inside Philip’s car on the way to Metro Town office, you never shared your location to your friends and boyfriend, do you agree?
Witness: Agreed.
Fikry: Do you agree that before you went up to the office at Metro Town, you did not share your location to your friends and boyfriend?
Witness: Not sure.
Fikry: While both you and Philip went up to the office, Philip did not pull your hands and force you to go up to the office, do you agree?
Witness: Agreed.
Fikry: When Philip opened the office’s door, you did not try to run away but you followed him to enter the office, do you agree?
Witness: Agreed.
Fikry: Before you went up to the office, you had choices such as sending your location at Metro Town to your friends and boyfriend or following Philip to go up to the office but you chose to follow him, do you agree?
Witness: Disagreed.
Fikry: The purpose of Philip bringing you to Metro Town office was to inform you that the programme would be held there, do you agree?
Witness: Agreed.
Fikry: When you boyfriend called you, you did not tell him to fetch you at Metro Town, do you agree?
Witness: Agreed.
Philip is accused of molesting the Unduk Ngadau contestant on May 19, 2021 at 2pm, 3.30pm, 9.45pm and 10pm, respectively, at a staircase next to Ever Best Photo in Asia City, in Studio Darvel Bay Borneo Holidays Sdn Bhd in Asia City, in a moving vehicle while on the way from a dinner place to an old office in the city and in an office in Metro Town.
He was charged under Section 354 of the Penal Code, which provides for a jail term of up to 10 years or with fine, or with whipping or with any two of such punishments, on conviction.
Phillip, had on June 10, 2021 claimed trial to four charges against him.
The witness further agreed that she and Philip went to Imago shopping mall at 6pm.
Fikry: When you and Philip went to Imago shopping mall, you did not invite your friends to join you, do you agree?
Witness: Agreed.
Fikry: Even though your friends did not join you to Imago shopping mall, you still followed Philip to go there, do you agree?
Witness: Agreed.
She further agreed that after going out of Imago shopping mall with Philip, both of them also went to a hotel at Asia City.
She also agreed that Philip had helped her to bring up her stuff to the hotel room and Philip did not do anything to her when they were inside the hotel room.
Deputy Public Prosecutor Siti Hajar Mazlan conducted the prosecution, while Fikry was assisted by counsel Azhier Farhan Arisin.
Trial continues today (Wednesday).
