The Klang High Court has sentenced a former mechanic to 32 years in prison and 12 strokes of the cane after he was found guilty of murdering his girlfriend in August 2022.

The accused was previously sentenced to seven years in prison under Section 304(b) of the Penal Code on 17 October last year.

Man smothered his girlfriend after he refused to sign no-breakup agreement

The decision was made by Judge Norliza Othman after the prosecution successfully proved its case beyond a reasonable doubt against the 23-year-old accused at the end of the defence case, according to Berita Harian.

Amirul Amin Amirruddin was charged under Section 302 of the Penal Code for murdering 24-year-old Nurul Shahira Abdullah at a house in Lorong Haji Mahat, Kampung Sri Pandan, Klang at 7:18 PM. He was accused of smothering her with a pillow following an argument after he refused to sign an agreement promising not to leave her.

The post-mortem report, as confirmed by a prosecution pathologist, found that the victim died from suffocation after being smothered with a pillow.

“During cross-examination, the accused admitted that while smothering the deceased’s face, he saw her breathing slowly and struggling. He said he did so to stop her aggressive behaviour.

“The accused also knew that his actions could cause the deceased to be unable to breathe, as her entire face was covered with a pillow and humans breathe through the nose. He only stopped after he realised the victim was no longer resisting and had stopped breathing,” Judge Norliza added.

 

“There were other ways to calm the deceased besides using a pillow”

Norliza said the accused’s sworn defence in the witness box was merely a denial.

She added that during cross-examination, the accused also agreed with the prosecution that there were other ways to calm the deceased besides using a pillow.

“The court found no element of extreme provocation that would have caused the accused to act in such a manner. He had sufficient time to consider a more rational response and to calm the deceased when he refused to sign the agreement,” she said.

The sentence was ordered to run from the date of arrest on 24 August 2022.
