It was reported that the Malaysian Anti-Corruption Commission (MACC) plans to recommend criminal charges against two individuals in connection with its probe into alleged corruption involving the government’s RM1.1 billion deal with UK-based semiconductor design firm Arm Holdings.

Similar as in Malaysia, bribery is illegal in the UK.

In fact, not only bribery is an offence under the Bribery Act 2010 for British nationals or someone who is ordinarily resident in the UK, a body incorporated in the UK, or a Scottish partnership but it also includes bribery undertaken by them to bribe anywhere in the world.

The Bribery Act places obligations on companies to prevent bribery offences in their operations.

There are 4 key offences established by the Bribery Act 2010:

  1. offering, promising, or giving of a bribe to another person
  2. requesting, agreeing to receive, or accepting a bribe
  3. bribery of a foreign (non-UK) public official, and
  4. failure by commercial organisations to prevent bribery committed by their associated persons to obtain or retain business, or an advantage in the conduct of business.

The Serious Fraud Office (SFO) and the National Crime Agency’s International Corruption Unit (ICU) share primary responsibility for investigating allegations of International Bribery and Corruption. The Crown Prosecution Service (CPS) prosecutes international corruption investigated by the NCA and other investigative bodies.

Now that MACC has revealed that it plans to recommend criminal charges, they together with the 3 NGOs that lodged the initial report that resulted in a probe into alleged corruption involving the government’s RM1.1 billion deal with UK-based semiconductor design firm Arm Holdings, have a responsibility to lodge a report with the police in the UK.

The authorities in the UK viewed allegations of bribery and corruption involving UK companies, or foreign companies and/or individuals with a connection to the UK, seriously and expects that if anyone suspect that someone has broken the law, the matter should be reported to the police and the Serious Fraud Office (SFO) and the National Crime Agency’s International Corruption Unit (ICU) who share primary responsibility for investigating allegations of international bribery and corruption involving a UK national or UK incorporate entity.

For added measure, ordinary Malaysians who abhor and detest corruption and bribery specifically those undertaken by politicians and the political elites in Malaysia past and present, is encouraged to write to the Board of Directors of ARMS Holdings in the UK informing them that Malaysia and Malaysians do not welcome them and their irresponsible and corrupted behaviour.

Tell the Board of Directors of ARM Holdings that while we welcome them to invest in Malaysia, we, ordinary Malaysians does not welcome their corrupt practices.
