The declassified report by the Royal Commission of Inquiry (RCI) into the Batu Puteh case has reignited debates about Malaysia’s handling of its sovereignty claims.

The focus of the controversy is former Prime Minister Tun Dr. Mahathir Mohamad, who led the decision in 2018 to withdraw Malaysia's applications for a review and interpretation of the International Court of Justice’s (ICJ) 2008 ruling. The decision has since been labeled by some as a strategic misstep, a betrayal of national interests, or even an act of sabotage but blame it as a cabinet's fault.

The RCI’s Findings

The RCI concluded that Mahathir’s actions "might have deliberately induced" the Cabinet into withdrawing the applications, which were scheduled for a hearing in June 2018.

The report alleged that Mahathir’s letter to the then Solicitor-General (SG) implied a directive to cease pursuing both applications. Consequently, the SG informed Singaporean counterparts of Malaysia’s intent to withdraw, effectively finalizing the ICJ’s decision that Batu Puteh belongs to Singapore.

The commission recommended a criminal investigation under Sections 415(b) and 418 of the Penal Code, citing evidence of "cheating" and potential wrongful loss caused to Malaysia. However, this recommendation was not unanimous, with two RCI members asserting that Mahathir’s actions were more aligned with dereliction of duty than criminal intent.

A Nation Divided

Prime Minister Dato' Seri Anwar Ibrahim deemed the decision a "major treachery" against Malaysia, emphasizing the duty of any government to defend national sovereignty till the end. Critics argue that the Cabinet’s approval of Mahathir’s proposal lacked rigorous discussion, raising questions about collective responsibility.

Conversely, some, including veteran journalist A. Kadir Jasin, suggest pursuing compensation from Singapore through diplomatic channels rather than targeting Mahathir. This approach, they argue, would better serve Malaysia's interests and avoid the perception of a politically motivated witch hunt.

Strategic Oversight or Calculated Risk?

Mahathir justified his decision by claiming that the legal basis for the review was weak, based on assessments by international consultants. Yet, the RCI disputed this rationale, citing evidence that suggested the applications had a reasonable chance of success.

The broader implications are significant: Malaysia’s decision not to pursue the review application effectively surrendered its opportunity to challenge the ICJ’s ruling.

The interpretation application, however, remains open for refiling. Still, ongoing negotiations between Malaysia and Singapore under the joint committees complicate the matter, though the RCI noted that Mahathir’s reliance on a special agreement to justify the withdrawal was flawed, as the review and interpretation processes were legally distinct from an appeal.

Blame or Accountability?

The Batu Puteh case exposes gaps in governance and decision-making processes. While the RCI accuses Mahathir of unilateral action, it also highlights the Cabinet’s passive endorsement of his proposal. The debate now hinges on whether this was a strategic error or a deliberate act of negligence.

As the government weighs its next steps, the case underscores the need for transparency, accountability, and a balanced approach to protecting national interests. Whether Mahathir’s actions were treachery or merely a miscalculated risk remains a matter for historical facts and the courts to decide.
