The Consumers Association of Penang (CAP) is urging the Ministry of Health (KKM) to take a stand for public health by strictly enforcing the long-awaited Tobacco Products Control for Public Health Act 2024 (Act 852). This law, crucial for safeguarding the well-being of non-smokers and future generations, faces opposition from commercial industries demanding delays.
Don’t Let Profits Dictate Public Health—CAP insists KKM stay firm and avoid bending to business pressures, emphasizing the need for strict regulations on tobacco sales, advertising, and display.
Why This Matters
Act 852 isn’t just another law—it’s a lifesaver. With Malaysia poised to reduce tobacco exposure, this legislation aims to promote a healthier lifestyle, encouraging smokers to quit while discouraging non-smokers from picking up the habit. Tobacco-related illnesses claim thousands of lives annually, and Act 852 could significantly curb these numbers by preventing secondhand smoke exposure and limiting access to harmful products.
Industry Pushback: Don’t Let Profits Win
Despite the clear benefits, the tobacco industry and retailers, including the Federation of Sundry Goods Merchants Associations (FSGMAM), are pushing for a delay, claiming a lack of consultation and readiness. They argue that the restrictions on tobacco product displays and advertising were rushed, leaving them unprepared for compliance. However, CAP asserts that KKM must not entertain such requests, as public health takes precedence over commercial interests.
Strict Measures for a Tobacco-Free Future
CAP supports the firm regulation of all forms of tobacco products, including herbal cigarettes, e-cigarettes, and vaping devices, and calls for stringent bans on advertising, promotions, and product displays. By enforcing these laws now, the Ministry will help curb the rise of new smokers and protect the broader population from the dangers of secondhand smoke.

Tobacco companies have historically used marketing tactics that glamorize smoking and make it seem appealing, particularly to younger audiences. By strengthen the regulation for advertising and promotional activities related to tobacco products, we can effectively reduce their visibility and desirability. This includes not just traditional advertising channels, but also digital marketing and sponsorships that might reach vulnerable populations.
Take Action: Support a Healthier Malaysia
Now is the time to stand with CAP in calling for the full enforcement of Act 852. Join the movement toward a healthier, smoke-free future for Malaysia by urging KKM to resist pressure from industries that prioritize profit over people’s health. The future of public health is in our hands—support the firm implementation of Act 852 today!
