
Health Minister Dr Zaliha Mustafa clarified today that the proposed Generational End Game (GEG) aimed at ending smoking and vaping has been temporarily set aside, not abandoned entirely, following legal considerations. The absence of the GEG was notable in the newly tabled Control of Smoking Products for Public Health Bill 2023.
Dr Zaliha explained that the Attorney General's Chambers raised concerns regarding Article 8, suggesting potential challenges to the GEG. In response, the focus shifted to prioritizing regulations. The minister emphasized the urgency of regulating smoking products, particularly vaping, to avoid loopholes and ensure public health. In March, nicotine gel was removed from the Poisons Act 1952, creating regulatory gaps that the government aims to address promptly.
While the GEG policy has been temporarily shelved, the revised bill includes the term "minor" to empower the government to regulate individuals under the age of 18. Dr Zaliha underscored the government's commitment to stringent smoking product regulations, clarifying that the GEG postponement aims to address immediate concerns.
The revised bill also outlines substitute tobacco categories, covering various smoking products, including vaping devices, electronic cigarettes, and substances derived from tea leaves. Additionally, the regulation encompasses shisha due to its use of tobacco.
The Control of Smoking Products for Public Health Bill 2023, presented for its first reading in the Dewan Rakyat, omits the GEG policy. This policy initially sought to prohibit the sale and use of smoking materials, including electronic cigarettes, for individuals born on or after January 1, 2007. The revision follows the withdrawal of the Control of Tobacco Product and Smoking Bill 2022 to accommodate the updated version presented today.
Former Health Minister Khairy Jamaluddin criticized the omission of the GEG clause, alleging that it resulted from strong lobbying by tobacco companies rather than constitutional concerns. Dr Zaliha responded by stating that these were Khairy's personal opinions.
In essence, Malaysia's government is navigating legal intricacies to ensure robust smoking regulations, addressing immediate concerns while keeping the door open for the Generational End Game policy's future consideration.
