The Malaysian Bar made a significant decision during its 78th annual general meeting (AGM), opting to pursue legal action against the Pardons Board's controversial move to diminish the 12-year jail sentence and RM210 million fine imposed on former Prime Minister Datuk Seri Najib Razak. This decision came in response to the Pardons Board's decision to reduce Najib's penalties related to the misappropriation of RM42 million from SRC International Sdn Bhd.

Former Malaysian Bar president Zainur Zakaria proposed the motion, which was seconded by former Malaysian Bar president Yeo Yang Poh. The resolution calls for the Bar Council to promptly initiate legal proceedings challenging the legality of the Pardons Board's decision.

The motion argues that Najib's application for a pardon should not have been considered, given that he had served only a fraction of his 12-year sentence and had not paid the full RM210 million fine. Additionally, it asserts that the Pardons Board's decision appears to contravene Article 42 of the Federal Constitution and legal principles, implying that it acted beyond its authority.

The Malaysian Bar's stance reflects its commitment to upholding the rule of law and ensuring that legal processes are carried out in accordance with established procedures. By challenging the Pardons Board's decision in court, the Bar aims to address concerns regarding the fairness and legality of the pardon granted to Najib.

This development underscores the importance of maintaining the independence of the judiciary and upholding the integrity of legal institutions in Malaysia. The Malaysian Bar's decision to take legal action demonstrates its dedication to safeguarding the principles of justice and accountability.

The outcome of this legal challenge will have far-reaching implications for the country's legal system and the rule of law. It will serve as a test case for the judiciary's ability to uphold constitutional principles and ensure that justice is administered fairly and impartially.

As the legal proceedings unfold, all eyes will be on the Malaysian Bar and the judiciary to uphold the principles of justice and accountability, ensuring that the rule of law prevails in Malaysia.
