
In a recent court proceeding in Malaysia, a local man and four foreigners, including two women, pleaded not guilty to charges of trafficking six Indian women for sexual exploitation. The case was heard in separate Sessions Courts today, with the defendants facing serious allegations under the Anti-Trafficking in Persons and Anti-Smuggling of Migrants Act 2007 (Atipsom).
The primary accused, Bala Muraly Supermaniam, a 46-year-old manager of a plastic manufacturing factory, and his co-defendants—Sahayaraj Raju, 41; Thiruneelakandan Kasinathan, 39; Nithyarettamary Yesurajan, 39; and Karpagavali Jeyakumar, 24—are all of Indian nationality. The charges were read to them in Tamil by a court interpreter during separate proceedings overseen by Judges Datuk Ahmad Kamal Arifin Ismail and Fatimah Zahari.
The accused are charged under Section 12 of Atipsom, in conjunction with Section 34 of the same act. If convicted, they face prison sentences of up to 20 years and fines. Bala Muraly faces four counts, while Sahayaraj and Nithyarettamary each face three charges, Thiruneelakandan faces two, and Karpagavali faces one. The alleged offenses took place between December 24 of last year and April 24 this year at D’Secret Garden Condominium and Tune Hotel Danga Bay in Johor Bahru.
Bala Muraly, appearing before Judge Ahmad Kamal, was granted bail at RM8,000 per charge, with a requirement to surrender his passport and report monthly to the Tampoi Police Station in Johor Bahru. He faced similar bail conditions for additional charges before Judge Fatimah. Sahayaraj, who faced one charge before Judge Fatimah, was granted bail at RM30,000, with conditions to surrender his passport and report biweekly to the nearest police station. The other three accused were denied bail.
Additionally, Nithyarettamary and Karpagavali faced charges of overstaying in Malaysia, to which they pleaded guilty. These proceedings took place before Magistrate Hidayatul Syuhada Shamsudin. The offenses were committed at Block B Apartment Country Garden, Jalan Persiaran Alife Harmoni Utama. Karpagavali received a five-month prison sentence, starting from her arrest on April 19. Nithyarettamary was fined RM10,000, with a default prison term of 12 months if unable to pay.
The legal representation for Bala Muraly and Sahayaraj was provided by lawyer Mohd Fazaly Ali Mohd Ghazaly, while the other three accused did not have legal representation. The case highlights the serious nature of human trafficking charges and the legal consequences that follow. The Malaysian judicial system's commitment to addressing such crimes is evident through the stringent bail conditions and penalties imposed on the accused. The ongoing legal proceedings will further determine the fate of those involved in this case, as the court continues to seek justice for the alleged victims.
