
Kota Kinabalu: A jobless man without identification documents was acquitted and discharged by the High Court here today of trafficking 1,166.22 grammes of syabu, without being called to enter his defence.
Judicial Commissioner Dayang Ellyn Narisa Abang Ahmad acquitted Asmadin Abdurahim after ruling that the prosecution had failed to establish a prima facie case against him.
However, Asmadin was ordered to be referred to the Immigration Department for further action as he had no valid documents.
Asmadin was charged with trafficking the drugs at about 2.30pm on Oct 1, 2023, at the parking lot in front of the old Kota Belud market.
The offence under Section 39B(1)(a) of the Dangerous Drugs Act 1952, punishable under Section 39B(2) of the same Act, carries the death penalty or life imprisonment, and whipping of at least 12 strokes upon conviction.
Five prosecution witnesses were called during the trial.
Deputy Public Prosecutor Amira Khalili appeared for the prosecution, while Edward Paul represented Asmadin.
Meanwhile, a 60-year-old woman was charged in the Magistrates’ Court here with voluntarily causing hurt to her son-in-law.
Foo Ming Chu pleaded not guilty before Magistrate Marilyn Kelvin to the charge.
Foo is accused of causing hurt to the 37-year-old man at about 7pm on June 16 this year at a house in Taman Prestige Residences, Manggatal.
The offence under Section 323 of the Penal Code carries a jail term of up to one year, or a fine of up to RM2,000, or both, upon conviction.
The court fixed Oct 14 for pre-trial case management and released Foo on RM1,300 bail in two local sureties.
She was also warned not to tamper with the complainant.
