
Kota Kinabalu: A 37-year-old unemployed man was charged at the Magistrate’s Court, Wednesday, with assaulting his wife.
Nicholos Joseph Green allegedly committing the offence at 1.30pm on April 28, this year at a house in Kg Imbahan, Ketiau, Putatan causing injuries to the complainant’s left palm, left thigh and both ears.
Nicholos pleaded not guilty to charge.
The charge under Section 323 of the Penal Code read together with Section 326A of the same Code.
Section 323 carries a jail term of up to one year or a fine of up to RM2,000 or both on conviction while Section 326A states that whoever causes hurt to his spouse or former spouse, a child, a disabled adult, or other family members and commits an offence under Section 323, 324, 325, 326, 334 or 335 shall be punished with imprisonment for a term of twice as long as the maximum term for which he would be liable to on conviction for that offence.
The court set June 21 for pre-trial case management.
Nicholos was offered bail at RM1,500 in two local sureties.
In another case, a man pleaded guilty to a theft charge.
Md Alif Sedingki admitted to stealing RM4,000 from Noraziz Mahmud at 10.05am on June 3 outside the Central post office here.
The charge under Section 379 of the Penal Code carries a jail term of up to seven years or fine or both, on conviction.
The court adjourned to June 21 for facts and sentencing.
