Man charged with sexually abusing his daughter go on trial November

Kota Kinabalu: A 46-year-old self-employed, charged with two counts of committing physical sexual harassment against his daughter, will go trial on Nov 27-28 this year.

Sessions Court Judge Elsie Primus set the date for the man when his case was brought up for mention to fix the new trial date.

On the first count, the man is accused of committing the offence by putting his private part on his 11-year-old daughter’s private part between May 7, 2022 at 9pm and May 8, 2022 at 6am at the veranda of a house in Kota Marudu.

On the second count, he allegedly committed the offence by asking the daughter to hold his private part at the same place and time.

Read more The offence, under Section 14(a) of the Sexual Offences Against Children Act 2017, provides for a jail term of up to 20 years and whipping, on conviction.

Due to relations between the man and the alleged victim, the man will face additional punishment under Section 16(1) of the same Act which carries a jail term of up to five years and whipping of at least two strokes, on conviction.

The court ordered the man to be remanded further, pending the disposal of his case.

In another case, a man was sentenced to five years and six months’ jail plus a stroke of the cane for taking syabu repeatedly.

Saizull Abdul Rahman was found guilty and convicted of committing the offence.

He was found taking the drugs on Aug 4, 2020 after testing positive for the drug at the police station here. He had several conviction records for taking the drug.

The court ordered Saizull to serve the sentence from the date of his arrest.

After completing his sentence, Saizull was ordered placed under police supervision for three years.
