Man cleared over fatal shooting of burglar at his home

  • A homeowner in Derbyshire will not face criminal charges after shooting dead an intruder, Marcus Smith, 19, who was pronounced dead on May 1, 2024, at a remote property in Whaley Bridge.
  • The man, in his 50s, was arrested on suspicion of murder after discharging a legally-held firearm when confronted by burglars in his home.
  • The Crown Prosecution Service (CPS) decided against bringing charges, citing the householder's rights to defend themselves, following a police investigation and review of evidence.
  • The homeowner has been released from police bail, with no further action to be taken against him in relation to Mr Smith's death or serious injuries to another person.
  • Separately, three men are set to face proceedings for burglary in connection with the incident and a prior burglary at the same property.
