Kota Kinabalu: A 44-year-old man was sentenced to 20 years’ jail and ordered to be given 10 strokes of the cane by the Sessions Court here for raping his teenage daughter two years ago.
Sessions Court Judge Marlina Ibrahim passed the sentence after ruling that the defence had failed to cast reasonable doubt on the prosecution’s case.
The unrepresented man was found guilty of raping his then 16-year-old biological daughter in a rented room at Inanam Point near here on July 6, 2024.
He was convicted under Section 376(3) of the Penal Code, which carries a maximum jail term of 30 years and whipping upon conviction.
The court ordered the man, whose defence relied solely on his own testimony after four prosecution witnesses had testified, to serve his jail sentence from his date of arrest on July 8, 2024, before being referred to the Immigration Department.
