Kota Kinabalu: A 32-year-old unemployed man was jailed 10 months by the Magistrate’s Court, here, for obstructing the police from carrying out their duties.
Mohd Faisal Awg Nasib pleaded guilty before Magistrate Wan Farrah Farriza Wan Ghazali to intentionally preventing a police team led by Sgt Dahlan Yusup from performing their duties by fleeing from inspection.
The offence was committed on Oct 18, at 6am, at a large drain in front of Desa Kastam, Jalan Sepanggar, near here.
The charge under Section 186 of the Penal Code carries a jail term of up to two years, or a fine of up to RM10,000, or both, on conviction.
The court heard from the prosecution that at 2.30am, on the same day, a police patrol team received information about a car chase between another police unit and a four-wheel-drive vehicle suspected of being involved in the theft of telecommunication cables.
The complainant’s team rushed to assist, and during the pursuit, the suspects’ vehicle allegedly threw hard objects at both police vehicles and rammed them.
When the chase reached the bridge area at Kampung Gudon, Manggatal, the suspects stopped the vehicle and four of them jumped into a river to escape.
With the help of villagers, police managed to arrest Mohd Faisal at 6am hiding in a large drain in front of Desa Kastam, Jalan Sepanggar.
Investigations confirmed that he was one of the four suspects who had fled from the vehicle, thrown objects, and dangerously rammed the police vehicle during the chase.
Duty counsel Carmen Khoo, representing Mohd Faisal, requested leniency on the grounds that he has two children and taking care of his aging mother and that it was his first offence.
Mohd Faisal was ordered to serve the sentence from the date of his arrest.
In a separate case, a 36-year-old man was jailed eight months for having stolen telecommunication cables.
Shahrizan Madin pleaded guilty before Magistrate Marilyn Kelvin to keeping two rolls of cable belonging to Telekom Malaysia on Oct 18, this year, at 2.39am, at a bridge in Kg Gudon, Manggatal.
He was charged under Section 411 of the Penal Code, which carries a jail term of up to five years and liability of a fine or both on conviction.
The prosecution informed the court that police investigations revealed the two cables, each three metres long, were found in Shahrizan’s possesion without any valid explanation.
Meanwhile, a man was charged with dishonestly misappropriating two bottles of engine oil belonging to his employer.
Einstein Junior pleaded not guilty before Magistrate Wan Farrah Farriza committing the offence at 12pm on Oct 18, 2025 in front of OBM Agency Services (M) Sdn Bhd, Lorong Kilang F, Kolombong.
He allegedly took two bottles of Motul 7000 engine oil worth RM140, belonging to the company, for his personal use.
The offence under Section 403 of the Penal Code carries a jail term of not less than six months and not more than five years, with whipping and a fine, on conviction.
The court fixed Dec 11 for pre-trial case management and released the accused on a bail of RM2,000 in two sureties.
