Man jailed for giving false statement

Kota Kinabalu: A 30-year-old man was jailed three days, Monday, for giving a false statement to police claiming he was robbed of RM8,500.

Mohd Affizan Ismail pleaded guilty before Magistrate Jessica Ombou Kakayun to give a false written statement to a police officer claiming that he was robbed of the money by three unknown men at 7.47pm on May 21, this year.

Affizan committed the offence at 9.30pm the same day at the investigating officer’s office at the Criminal Investigation Division of the police headquarters here.

He was charged under Section 182 of the Penal Code which carries a jail term of up to six months or fine up to RM2,000 or both, on conviction.

Read more The court heard that Affizan claimed in his police report that he was robbed by unknown men in the Alamesra area after withdrawing the money from the ATM machine at a bank and that he was stabbed with a sharp weapon on the back while fighting the men.

Police investigations revealed that when Affizan was taken to the crime scene for investigation, he trembled in fear when the police asked for CCTV footage from the bank and the surrounding areas. He confessed that the reported incident was just a fabrication.

Affizan admitted that he made up the story because he owed RM8,500 to his mother-in-law and was unable to pay the debt and had also stabbed himself with a small knife, said the prosecution.

Unrepresented, Affizan requested for leniency while the prosecution applied for an adequate sentence.

The court ordered Affizan to serve the sentence from Monday.

In another case, a 49-year-old man was charged with having a stolen motorcycle.

Nasir Sairan pleaded not guilty to keeping the stolen Yamaha motorcycle belonging to one Hanizan Abu around 9am on May 5, this year in front of an office at Kg Air here.

The charge is framed under Section 411 of the Penal Code.

The prosecution in applying for a mention date proposed bail at RM5,000 in two sureties.

Nasir applied for a lower bail amount.

The court set June 27 for case management and released the accused on a bail of RM2,500 in two sureties.
