Shah Alam High Court grants MCMC summary judgment against MajuBina Resources, ordering RM15.32 million in liquidated damages over JENDELA 1 delays in Sabah.

PUTRAJAYA: The Shah Alam High Court has granted the Malaysian Communications and Multimedia Commission (MCMC) a summary judgment against MajuBina Resources Sdn Bhd, ordering the company to pay RM15.32 million for failing to complete work under the National Digital Network (JENDELA) project in Sabah within the stipulated period.

In a statement today, MCMC said the RM15.32 million represented liquidated damages for delays in carrying out work under the JENDELA 1 project. The court also ordered the company to pay RM5,000 in costs to MCMC.

The commission said the legal action was filed in February this year to recover the damages arising from delays in implementing the communications infrastructure project, which was part of the Universal Service Provision (USP) initiative.

MCMC said the JENDELA 1 project was aimed at expanding communications coverage and access, particularly in rural and underserved areas.

“The court’s decision also underscores the importance of accountability in the implementation of the country’s communications infrastructure projects,” it said.

MCMC stressed that all communications infrastructure projects funded through the USP fund must be implemented in accordance with contractual obligations and agreed timelines.

“Compliance with these requirements is essential to ensure the smooth implementation of projects and enable the people, particularly those in rural and underserved areas, to benefit from digital connectivity,” it said.

The commission said it would continue to ensure that the USP fund was utilised responsibly to improve public access to quality communications services.
