
Millions of Americans working on Memorial Day could receive larger paycheques this month, but only if they meet certain overtime conditions during the workweek. Although Memorial Day is a federal holiday, employers are not automatically required to offer extra pay for working the holiday.
Workers May Qualify for Time-and-a-Half Pay
Under federal labour law, employees generally become eligible for overtime pay once they work more than 40 hours in a single workweek. That means Americans working on Memorial Day may receive time-and-a-half pay if their total weekly hours exceed the overtime threshold.
Workers who do not cross the 40-hour mark are not automatically entitled to extra holiday pay under federal law. Many employees wrongly assume federal holidays guarantee premium pay, but rules vary depending on employers and contracts.
Some Companies Offer Extra Holiday Pay Voluntarily
Although businesses are not legally required to provide additional pay for Memorial Day shifts, many companies choose to offer holiday bonuses or premium rates voluntarily. If employers promise extra holiday pay in contracts, employee handbooks or official company policies, they are generally expected to honour those agreements.
Workers are being encouraged to check their workplace policies carefully before the holiday weekend to understand whether they qualify for additional pay or overtime rates.
Some States Have Separate Holiday Rules
Certain states apply additional protections and rules for workers during Memorial Day. In Massachusetts and Rhode Island, some employers cannot force staff to work on the federal holiday. Massachusetts also allows military veterans to take leave for Memorial Day events such as parades and ceremonies, explains The Sun.
Meanwhile, salaried employees classified as exempt from overtime rules are normally still entitled to receive their full salary if the business closes during the holiday week, provided they worked part of that week.
Companies Can Set Conditions for Holiday Pay
Employers can also create rules requiring workers to attend shifts immediately before and after Memorial Day to remain eligible for holiday pay. However, some companies may still make exceptions for employees who arranged approved leave in advance.
Labour experts say company policies often vary widely depending on industry and employer practices.
Memorial Day Remains One of the Biggest Federal Holidays
Memorial Day is observed every year on the final Monday of May to honour military personnel who died while serving in the armed forces. It remains one of the busiest travel and retail weekends of the year across the United States.
Other remaining federal holidays this year include Juneteenth, Labor Day, Veterans Day, Thanksgiving and Christmas Day.
