
Kota Kinabalu: The Magistrate’s Court here, Tuesday, sentenced a 47-year-old man to six months’ jail and ordered him to get one stroke of the cane for misappropriation of property.
Sales assistant Muhd Esa Victorio, 47, pleaded guilty before Magistrate Stephanie Sherron Abbie to dishonestly using the RM1,520 cash belonging to a company at Syarikat Miraway Sdn Bhd, here, Dec 15 last year.
The charge, under Section 403 of the Penal Code, carries a jail term of between six months and five years and whipping and liability of a fine on conviction.
Duty counsel Carmen Khoo representing Esa requested a lenient sentence as he was remorseful.

In another case, a 54-year-old food vendor was given a discharge not amounting to an acquittal (DNAA) from a charge of cheating a man of RM2,000 over the sale of a vehicle.
The Magistrate released Jackson Koh Kok Fah after being informed that the DPP’s office had withdrawn the charge.
Koh’s case came up for pre-trial case management on Tuesday.
On Nov 10 last year, Koh claimed trial for allegedly cheating one Yohanes Sanih by making him believe that he (Koh) sold a 4x4 Isuzu vehicle, which caused Yohanes to hand over RM2,000 to him, which was allegedly committed in a restaurant in Donggongon town, Penampang on Dec 11, 2018.
The charge was framed under Section 420 of the Penal Code.
