
The Ministry of Health (MOH) is tightening regulations regarding the ban on the sale of all smoking products, including electronic cigarettes, through vending machines. These regulations will be enforced alongside the Control of Smoking Products for Public Health Act 2024 (Act 852), once it receives approval.
In a recent statement, the MOH addressed public concerns after complaints about electronic cigarettes being sold through vending machines surfaced on social media platform X on July 10. The ministry emphasized that the prohibition of vending machine sales for e-cigarettes is an extension of existing regulations under Regulation 10 of the Control of Tobacco Product Regulations (PPKHT) 2004, governed by the Food Act 1983 (Act 281). This regulation already bans the sale of traditional tobacco products, such as cigarettes, cigars, and loose tobacco, via vending machines.
Following the viral spread of these complaints, the MOH took prompt action by meeting with the management of the shopping center where these sales were reported. During this meeting, the ministry reiterated the ban and recommended the immediate shutdown of the vending machine in question. The shopping center management agreed to this measure as part of their corporate social responsibility.
To ensure smooth enforcement of Act 852 and its accompanying regulations, the MOH has been proactive in conducting a series of briefings for enforcement officers from both the ministry and local authorities nationwide. These briefings, which began on June 9, aim to educate officers on the new prohibitions, including the specific ban on vending machine sales of smoking products.
The MOH’s initiative underscores its commitment to public health by strictly regulating the sale of smoking products and addressing any breaches swiftly. As the ministry awaits the final approval of Act 852, these preparatory measures highlight the serious stance taken to safeguard public health and curb the accessibility of smoking products, particularly through automated vending solutions.
