Molesting niece: Man granted bail

Kota Kinabalu: A 36-year-old labourer charged with committing physical sexual harassment against his niece was granted bail by the Sessions Court on Wednesday.

Judge Amir Shah Amir Hassan allowed bail for the man pending the disposal of his case.

The court offered RM8,000 bail in two local sureties but with several additional conditions.

Among the conditions were that the man report to the Penampang police station on every first day of the month and prohibited from contacting or tampering with the prosecution witnesses.

The man is accused of committing the offence against the 11-year-old girl by fondling her breasts in the morning on Dec 31, 2022 at a house in Jalan Novunsu, Penampang.

On April 11 this year, the man claimed trial to the offence under Section 14(a) of the Sexual Offences Against Children Act 2017 which provides for a jail term of up to 20 years, and whipping, on conviction.

Deputy Public Prosecutor Najiha Farhana Che Awang appeared for the prosecution while the man was represented by counsel Mohamad Syazwan Shah Mohamad Ali.

In another case, an illegal immigrant was jailed four months for entering the State illegally.

Sessions Court Judge Azreena Aziz meted out the sentence to Najmi Tangan who was arrested on May 27 this year after failing to produce his identification documents to the police in Penampang.

The court ordered Najmi to serve the jail sentence from the date of his arrest and referred to the Immigration Department after completing the jail sentence for his biometrics data to be recorded before deportation.
