Mowing into man: 35-yr-old gets jail and caning

Kota Kinabalu: A 35-year-old man, who caused grievous hurt to another man by accelerating his vehicle which struck the latter, was jailed 13 years and ordered to get three strokes of the cane.

Sessions Court Judge Elsie Primus meted out the sentence to Wan Han Lin who pleaded guilty to the charge against him.

Wan had voluntarily caused hurt to one Kong Chi Siong, 38, by mowing into Kong at 12.30pm on Nov 6, 2022 in front of the Kedai Alteccom 2, Grand Millenium in Penampang.

The offence, under Section 326 of the Penal Code, carries a jail term of up to 20 years and liable to fine or whipping, on conviction.

The court ordered Wan to serve the jail sentence from the date of his arrest on Jan 11 this year.

In mitigation, Wan who was not represented asked for leniency.

However, Deputy Public Prosecutor Siti Hajar Mazlan urged the court to impose a deterrent sentence on the grounds that it was a serious offence as the action committed by Wan was dangerous and could harm to the victim as well could lead to his death.

Siti informed the court that based on the medical report, the victim suffered right skull fracture with contusion brain haemorrhage, left tibial, fibular fracture, right shoulder lebral tear and multiple abrasion wounds.

The court heard on the said day Wan went to Kong’s shop to buy reload coupons.

Wan then told Kong that he wanted to take his handphone from his car and Kong followed.

Upon arriving at the car, Wan reversed and sped off but Kong tried to stop him. However, Wan drove off and hit Kong who later fell on the road.

Kong was immediately taken to hospital for treatment.

Following a police report lodged by Kong’s brother, Wan was arrested on Jan 11 this year at a house in Jalan Long Tuma Kg Long Tuma, Lawas in Sarawak.
