Tan Sri Muhyiddin Yassin expressed disappointment today after losing a defamation case brought against him by DAP Chairman Lim Guan Eng, but he intends to appeal the decision. The Perikatan Nasional (PN) chairman conveyed his thoughts in a social media post, sharing his disappointment while respecting the court's ruling. Muhyiddin, Malaysia’s former prime minister, is now preparing to challenge the outcome legally, arguing that his statements were not defamatory and that the damages awarded were excessive.
The High Court ruled in favor of Lim, ordering Muhyiddin to pay RM1.35 million in damages over comments regarding the revocation of a tax exemption granted to Albukhary Foundation. This court decision came after Judicial Commissioner Roz Mawar Rozain determined that Lim had successfully demonstrated that Muhyiddin’s statements were defamatory. In response, Muhyiddin announced that, in compliance with the judgment, he would be removing the posts that formed the basis of Lim's lawsuit from his social media platforms.
Muhyiddin's remarks on Facebook highlighted his stance on the issue. He asserted his intention to appeal, claiming a strong defense against the defamation claim. He noted his belief that his comments were neither defamatory nor intended to damage Lim’s reputation, expressing confidence that the statements he made were rooted in a legitimate perspective on the issue.
The dispute between the two political figures stems from statements Muhyiddin made in March 2023, when he posted a series of comments on Facebook about Lim’s involvement in the Albukhary Foundation’s tax exemption status. Specifically, Muhyiddin’s remarks on March 9, 11, and 12, 2023, included allegations regarding Lim’s role in the tax decision, which Lim argued were false and defamatory, damaging his reputation.
Following Lim’s legal action, the court examined the statements and found that Muhyiddin's comments did indeed harm Lim's standing. As a result, Judicial Commissioner Roz Mawar Rozain ruled in favor of Lim, ordering compensation based on the extent of the reputational damage caused.
Muhyiddin emphasized that while he respects the judicial process, he remains determined to overturn the decision through appeal. He is set to challenge not only the characterization of his statements as defamatory but also the amount of damages awarded, which he views as disproportionate. Muhyiddin has since instructed his legal team to initiate the appeal process.
This legal battle underscores the tensions between prominent political figures in Malaysia, especially as public discourse increasingly unfolds on social media. Muhyiddin’s decision to remove his posts reflects compliance with the court’s decision, though he remains firm in his belief that his comments were justifiable and should not be construed as defamatory.
The defamation ruling highlights the delicate balance between freedom of speech and the preservation of public reputation in Malaysia. Both Muhyiddin and Lim are influential political leaders, and this case is likely to spark discussions about defamation laws and political accountability within the country. As Muhyiddin’s appeal progresses, it will be closely watched by the public, as the case may set a precedent for how similar political disputes are handled in Malaysia’s legal system.
