
Kota Kinabalu: A bird’s nest agent claimed trial in the High Court, Friday, over the murder of a man outside an entertainment outlet in Penampang, last year.
Kaw Yung Chee, 36, was accused of murdering Jusmani Duragan, 30, at 3.26am on Jan 4, 2022, outside the Maple Karaoke Lounge.
Kaw pleaded not guilty before Judicial Commissioner Amelati Parnell after the charge under Section 302 of the Penal Code was read out to him.
The charge carries the death penalty or imprisonment of between 30 years and 40 years and if not sentenced to death, must be whipped a minimum of 12 lashes, on conviction.

Amelati maintained the date for the hearing of the notice for bail application and ordered Kaw to be remanded further as the charge against him has no provision for one.

Meanwhile, an unemployed man was jailed six months for committing mischief by damaging the properties belonging to a businessman in Penampang last year.
Azmi @ Andrew Ghani, 43, pleaded guilty before Magistrate Lovely Natasha Charles to damaging the house walls, fence and the excavator machinery belonging to Nasirudin Anjud at 3.57am on June 5, 2022 in the compound of a house in Kg Tunoh, Penampang.
The offence under Section 426 of the Penal Code carries a jail term of up to five years or fine or both, on conviction.
Earlier, the court was informed by the prosecution that Nasirudin, who was resting inside the house, was told by his wife about the noise outside the house and he saw Azmi, who is known to him, damaging the excavator machinery, the fence and the fence wall of his house using hard objects.
The estimated loss was RM500, said the prosecution.
Azmi had also threatened to throw an axe at the complainant when he was told to go home and Azmi said the complainant was arrogant.
The complainant was not sure why Azmi acted in such a way and Azmi only left after the complainant threatened to call the police, the court heard.
Further investigations revealed that Azmi was a homeless person after his house was burned down and before the incident, the relationship between the complainant and Azmi was normal and did not have any problems and that there were no disagreements or arguments between them before the incident, said the prosecution.
Duty counsel Carmen Khoo, representing Azmi applied for a lenient sentence as he was remorseful.
Meanwhile, a 31-year-old housewife was jailed two weeks for shoplifting.
Nurul Haziqah Ramli admitted before Magistrate Stephanie Sherron Abbie to stealing a packet of instant Kopiko LA Coffee, a packet of Nestum and a unit of moisturizer at 12pm on July 19, this year at the CKS, Plaza Manggatal.
She was charged under Section 379 of the Penal Code which carries a jail term of up to seven years or fine or both, on conviction.
The prosecution informed the court that Nurul was seen entering the premises in a suspicious manner and was seen stuffing the said items into her bag before she walked out without paying.
Nurul was detained outside the premises and handed to the police.
